You have to wonder how tenuous Apple's position was considering that they have settled so early (in huge lawsuit time). 100 million dollars is a lot of money to spend to get Creative off their back.

Hardly any at all. Apple has $10 billion in cash in the bank.

Even at a measily 3% interest, Apple will make $300 million in interest alone, not accounting for the fact that they are adding about $3 billion to their cash horde per year.

To look at it another way, iPod will generate tens of billions of dollars in revenue going forward for Apple. For Creative to settle for a measily $100 million out of tens of billions means they were desperate/forced to settle. Considering Creative all but accused Apple of stealing their design to make the iPod, settling for pennies on the dollar is not a sign that Creative was bargaining from a position of strength.

Rather, it was Apple probably dictating the terms.

Look at it another way. RIM - the makers of Blackberry - settled with NTP for $450 million after spending tens of millions of dollars and years fighting NTP in court. NTP, like Creative, claimed RIM infringed on important patents in making the popular Blackberry device.

During fiscal RIM made $2 billion total revenue. That's about as much iPod makes each quarter.

In other words, NTP was able to extract 4.5 times the licensing fee for a product that generates just 1/4 of the iPod's revenue.

I don't think it was Creative who won here. Creative, most likely, was desperate to settle so it could move onto other, more important battles, like figuring how it can survive the Zune onslaught (which is why becoming a paying member of the "Made for iPod" club is suddenly significant).

I wonder if these people are buying one to "test it out" or are buying multiple movies.

Well, I bought one "to test it out" (as I've done with each iT[nee M]S intro.)

But I also bought a couple TV shows that I had wanted before, but didn't want at 320x240. The 640x480 version of the Babylon 5 Pilot looks just as good as my DVD copy. (And it's nice, because it's the as-originally-aired version, not the TNT give-plot-away-early edit.) The CG looks a little worse, but that's because it was worse. (They re-did some of the CG for the TNT version.)

Ok I think Steve is just playing with the rumor sites. First is was "G5 Powerbooks next Tuesday" Now its "iPhone next Tuesday, quarter, macworld, whatever." I think its just his way of palying a practical joke on us plebes. Probably sits back, snorts derisively whenever he sees this and throws a towel at his personal servant (whose name is Steve Ballmer).

I want to see some unpacking pics of that 24inch model compared with the 20in. Soon enough I suppose.

yeah that 24 incher is a very tempting deal.

I have a Dual Core 2.0 G5 and a 20 inch monitor. I'm considering selling just the G5 and Getting a Low End Mac Pro. Or selling both and getting the iMac. I know that MacPro is better, but the price compared to what you get with the iMac is just too good. So torn.

But also looking at My 20 inch ACD right now, I can't help but think how F*#king huge that iMac must be. If they made an all black one thouth it would be over. I wish they made black ACD's and MacPro's too now that i think bout it.

If I bought one of these, could I put it in my Intel iMac and have it work?

What sense would it make for Apple to update the iMac twice in such a rapid succession? If anything, Apple's hardware cycles are getting even longer, mostly around 10-12 months in recent years. And at least from Intel, there will be nothing new to put into these machines by that date.

It's not unusual for Apple to update the iMac twice in a year. They did it in 2005 and three times in 2003. Hardware is always changing, and iMacs get speed bumps or redesigns to reflect those.

Lion is going to be released about a month after the new iMac, so if the redesign somehow really coincides with the release, it will probably happen right now.

That would make Lion being released first or second week in June. That's possible of course, but highly unlikely. My guess is sometime in August, or early September.

I still find the fact that Creative will be making products for the iPod the most interested aspect of this case - but damn, 85 cents a share is crazy high  !

Did anyone pay attention to the power and thermal requirements of Conroe?

other than the extreme edition (which i don't suggest should go in an iMac) i doubt its any more than the G5 that was in there before....

I read a good tweet about this:

Password protect your phone. Password protect your computer. Nothing has changed.

The iPhone is sold on how easy it is to use and that you don't have to fiddle with things. But it's shown time and time again that despite everything they do to keep it as simple and user friendy as possible, it's not true.

Most iPhone users won't have a clue about how to do this. If Apple had actually encrypted the file this wouldn't have been this huge problem.

Wahoo! I'm hoping for a couple of things:
    1. The mac mini has an upped processor and can support 5.1 channel surround sound
    2. Macbooks and macbook pro's to have the memrom
    3. iMacs with conroe
    4. An ipod update for the video and nano
    5. All these rumors of an iphone. Maybe we'll get one maybe we won't? I'm not expecting it to be released on the 12th.

Reports that Apple will be hosting a special media event on September 12th began emerging yesterday (http://www.macrumors.com/pages/2006/08/20060831122800.shtml). According to multiple reports, Apple will be hosting the event in San Francisco which will be also streamed live to London.

MacOSXRumors now claims (http://www.macosxrumors.com/articles/2006/09/01/23-inch-imac-coming-on-september-the-12th/) that Apple will be revamping the iMac line with the new Core 2 Duo (Merom) processor at this event, with the additional introduction of a 23" iMac.

Larger iMac form-factor rumors were amongst the reject rumors (http://www.macrumors.com/pages/2006/08/20060805230811.shtml) for pre-WWDC rumors. MacOSXRumors, however, cites "reliable sources" for this report and did have some accurate predictions (http://www.macrumors.com/pages/2006/08/20060805162310.shtml) for Leopard (virtual desktops, tabbed iChat).

I'd actually say they'd be more likely to go straight Conroe, TDP is the same, has speedstep so it throttles back, and the Conroe has a bigger L2 Cache- just like the Meroms that would be most likely for the iMac.

I think this is all the more reason why they'll go with an Allendale, it's not as high of a performace chip but it does exceed the performace of the Meroms. It's a desktop chip, designed for lower end desktops, not a mobile chip without as much power.

Macs as far as I know are not easily tossed out. apple computers have been primarily hand me downs unless some terrible accident happened rendering it useless.
My cousin's iBook died last winter. I discovered he disposed of it, not sure if he did environmentally-well or not. But since he should've given it to me, even though dead, I had to shoot him. That's one that won't hose the environment anymore!

(this post is partly hyperbole.....no Apple is ever "dead")

    Rivalry or acquisition?

i'm sorry but the 30G iPod has a stupid price. If someone is that tight and has to get an iPod, they would probably buy used.

there are plenty of reasons people might avoid buying a used ipod, or simply want a new one.

speaking for those of us who are, as you put it, "tight," i for one would appreciate it if you... didn't.

$350 is 40% more than $250. to some of us, that's a lot. i think apple understands that, and probably has some pretty damn good data behind their pricing scheme.

i have to say, reading all these whiny complaints, everyone sounds like Comic Book Store Guy from the simpsons. i don't get where exactly the sense of entitlement comes from? i mean, obviously they're doing the best they can... what, are they holding back some awesome features, just to piss you off?

'07? They've been planning for for years is seems like and '07 is the best they can do? It seems that Apple has a choice.

    1) Make a simple phone, make it look good and work well.
    2) Take phones to a new level

I'd happily have a #1, but if their choice is #2 they may be trying to achieve things that mobile phones haven't done before.

The most obvious of these would be to be a wireless VoIP phone - for use at home (ie iChat over Airport), as well as at work, at hotspots they've negotiated with (possibly a big play in conjunction with Google wireless?), and roam to 3G cellphone networks the rest of the time. This sort of thing may be a little complex :)

Not that much. Not 100 million smackers.
As has been mentioned the typical patent litigation is in the $5-$10 M range paid to the attorneys. With the main lawsuit and 5 countersuits they could have made a big dent in that $100M. Even when you have a large legal staff, litigation is usually handled by outside firms that specialize in those kinds of trials. With 32 million iPods sold in 2005 even a $3 licensing fee (~1% on average is not an atypical licensing fee) you'd easily surpass $100M if you were planning to sell iPods for more than 1 more year. A lump sum is preferable.

There are also less obvious or tangible costs. Uncertainty is never good buyers may shy away from a purchase if they feel there is a potential that the product will soon be abandoned/unavailable. There's also the fact that the discovery process in such lawsuits is often used as a tool to try and pry information out from the other side, such as future product plans, etc. that might well be worth big $ keeping undr wraps. And last but not least is the distraction that such a suit tends to place on the key employees who may be involved in designing a workaround or simply being deposed and directly involved with the trial.

Very sad. Someone lost their life over something so trivial. And sad that the guard has to live with knowing he took a life. :(

    Coleman2010,

I would not say that committing armed burglary and shooting at an outnumbered security guard is "something so trivial".

The guard can live with the fact that someone tried to take HIS life, but fortunately he was trained well enough to defend himself successfully.

Quit feeling sorry for criminals who CHOOSE to be criminals, and try your best to figure out that the person perpetrating the crime is NOT THE VICTIM!

This is it, I'm getting one. Or I hold out and wait. The thought still roams my mind that they dropped it by 50$ to make room for a 300$ fullscreen video iPod. So I'll hold out. If there's no touchscreen, fullscreen, w/e iPod, I'll get this one plus dock.

The way i see it, is that the headshot wasn't point blank but rather unlucky as the robber got to his car before puffing his last breath. Maybe the robber moved his head in the trajectory, maybe the bullet bounced on something. Who knows what happend, but it doesn't sound like an aimed headshot to me.

How would Safari be able to install that stuff? Forgive me for not knowing, but I haven't seen anything that allowed you to install software, or any executable code, from iOS Safari. Not with Apple's model. Maybe jailbroken, but that's a different story.

you don't remember www.jailbreakme.com last year? you swipe and it installs all kinds of code on your iphone
