Hi,
I have a situation and will appreciate thoughts on that. I was working in a company on H1B and my company got closed and Moved back to India after 2-3 months.
Now I found a new employer who has a project for me but want me to join in 1-2 weeks. SO I was wondering what options do I have?
Is it possible to apply for B1 for some time and come and simultaneously apply for H1 Transfer.
Please let me know. Your help is appreciated.

B1/B2 is not intended for work (or to even to seek work) - The best way is to apply for H1 in premium, get it stamped and go back. If everything goes smooth, total turnaround time would be 4 weeks tops.

Post date is NOT Important. What's important is the "delivered" date. Think about. USCIS can't and is not responsible for postal delays. If one sends a package and somehow it does not get delivered for 14 days, USCIS cannot mark the application received until and when it receives it, period.
Please check before posting untrue statements. So even if your application reaches the uscis on the July 3rd, but uscis enters your application to the system on August 1st, your filed date will be July 3rd. So don't worry. Make sure your package reaches USCIS in July and you will be OK.

No issues on both fronts as long as you have adhered to the terms and conditions while obtaining the Canadian Visa. I had similar circumstances in the recent past.
A factor to consider is the unpredictable time spent at the secondary inspection when returning. I am not sure how that will work when you drive across the border.

I am currently working as a Functional Solution Architect in an IT firm.
Current Status: H1B (6th year)
GC status as follows:
Priority Date: April 2007
EAD received: October 2007
I-140 is approved.
Under the AC21 portability I believe I can change my employer without affecting my GC process. However I want to change my field of work from IT to Finance. My question is:
1. Is that permissible and can I use my EAD to work for a new employer in a different field.
2. If the above is not permissible and If I change my job in the same field, can my previous employer cancel my GC process, even though my I-140 is approved. If they can, how can I mitigate that possibility.

Now that Aug is coming up, please post all the 485 LUDs that you have been seeing after 07/18/2008. This will help us getting the pattern, in case USCIS shall auto order the Card production.
no one is auto-ordering card production (whatever that means).
lets stick with vdlrao's thread to track Augusts approvals please. no need for another thread for teh same topic.

Lost I20.
Went to school from 96 to 2000.
WOrking on H-1 since then.
Numerous trips outside. Last one in 2005 on an H-1 visa.
What do I do now?
You can call the school's "Office of International Studies"(or equivalent) and ask for a copy.

I have an opportunity to do some consulting work for a company B on a part-time basis apart from my current full time job with company A. I know that I will need another H1 for the part time gig but what I am confused about is whether the company B has to wait for next years quota to file for an H1 or can it file immediately ? Meaning is the H1b quota tied to max no of individuals ? or to max no of positions ?

If the employer agrees not to revoke the 140, Can I change the employer after getting EAD. 485 application is pending but less than 180 days.

Hi,
I have approved labor (filed Apr 2004 and cleared Jan 2007) in EB2 category. But it was filed wrongly in EB2 as somehow it got cleared. But now I got RFE on I-140 and there is a verly bleak chance of getting it cleared.
In the meantime I am thinking to file a new labor by PERM (from same employer). I have few questions regarding this:
1. Can I file new labor in PERM without affecting my current labor and I-140 ?
2. Do I have to mention in my new labor about my old labor and I-140 ?
3. Can I use different experience letters in new labor as my old labor is in jeopardy because of experience letters only.

1) I had read somewhere that USCIS was going to stop the same. Has that happened yet?
2) Say a person has applied for the I-140 but cannot simaltaneously apply for 485 due to retrogression. In the event that the dates become current BUT the I-140 is not yet approved, can the person still file for the 485 under the simultaneous filing or does he have to wait till the I-140 is actually approved?
Once a I140 is filed without the I485 one has to wait for I140 approval before being eigible for filing I485

I am now "current" with Nebraska and the latest Visa Bulletin. I have completed all other hurdles (including finger printing) how long should I expect now to wait now for my green card to be adjudicated ?
Also, I have no idea about the FBI name check.. How do you even know if your file is being held up because of an FBI name check ?

The March 2008 Visa Bulletin indicates they are proceessing up to priority date of 01 Jan 2005 (my PD date is Jan 2004)
And

One cannot work on H4.
i was told by my lawyer - if spouse stops working, s/he can go back to H4, but you need to confirm with a lawyer, given your specific case.

This is from USCIS point of view. So they include all categories of I485 -- most will probably be family based. The I140 is exclusive to EB class. Of course USCIS does not publish stats that we would find really useful, even their process dates are works of fiction (or at least not totally accurate).
