    Agreed.... Macs had windows long before PC's had "Windows". I think that if one can be a trademark then the other surely can. Personally, I think that if there were no such precedence, then neither should be allowed as a trademark. But terms like this have been allowed as trademarks for quite some time. Microsoft should just drop it -- what is their vested interest here anyway? There are a thousand things they can call their application store.

    Microsoft's interest is obvious. They want to create marketplace confusion to aid in the sale of an inferior product. You know, the thing trademarks were designed to protect against..

    You say App Store, everyone on the planet who does nut have their head shoved up their backside only thinks of one thing. Before Apple made the App store, no one thought of anything at all when you said it...

    ....but can't find anywhere hard evidence for September 12. Macbidouille is referencing conformation from sources, but don't have a date. Hardmac has a copy of a meeting invite for the 19th. So, will there be a September 12 meeting? I really hope so, as I will be in Vegas that day, and don't mind to pick up some stuff at the Apple store. :)

    If anyone at Apple HQs is listening, please give us a revved up/priced down MBP. Merom + 160 GB/7200 rpm hdd at $1999 would be sweet. I don't care to watch movies on anything less than a 50" screen, and I sure as hell am not moved to tears by an 8GB nano that is priced at 75% of a regular iPod. C'mon Apple, it's not too late!

    If they release MacBook Pros, I wonder if the top end models will come with a Blu-ray option. I know people have dismissed this before but I just noticed that Sony has released "The world's first Blu-Ray disc enabled notebook." Will the 17" MBP be next?

    There is vision and there is execution. Our democratic system of zigging and zagging every 4 to 8 years is hurting us. And no one involved in running government even when conservatives with the stated intent of dismantling government seems to be able to remove the inefficiencies.

    I see 3 paths:
    1. Anarchy- no government
    2. Minimalist government- handles very basics of infrastructure and laws and enforcement. When it comes to social economic issues, every person for them selves.
    3. Caretaker government- takes care of everything for us.

    I think we should be somewhere between #2 and 3, however this is based on an efficient government which can be argued is an oxymoron. ;) When people in economic power display morals, then less regulation is needed, otherwise you need to regulate the hell out of them. For the last 30 years we have been sliding into the realm of pure unadulterated greed. If you don't have a people oriented government acting as the referee, then you'll find yourself right back in the 1800s with the little people holding up the barrons and Captains of Industry upon their shoulders. That is not equitable imo.

    Anybody responsible for guarding should have a gun. If the person isn't qualified to carry a gun, they he/she isn't qualified to guard anything and shouldn't be a guard.

    When you're exchanging gunfire with a criminal, the main goal is not to wound; it is to remove the threat to your life completely. Let's say the guard shoots the guy in the arm, the guy's going to be so pumped up on adrenaline that he's not going to even know he's shot, giving him plenty of opportunity to take another shot.

    Ask yourself this: If it were your life he was guarding, what would you want the guard to do?

    Maybe you're right, maybe not... I mean, I doubt the guys went in in Kevlar suit saying "we take the loot, not matter what. If someones try to stop us, we kill him". In a bank robbery maybe they would but I doubt they were ready to kill somebody only for a few iPads...

    But that's just me.

    Mac mini - Core Duo (Yonah)

    Mac Pro - Xeon (Woodcrest)
    Xserve - Xeon (Woodcrest)

    * Unlike the other models, the MacBook and MacBook Pro have not seen updates (http://buyersguide.macrumors.com/) for 4-5 months. As a result, many are speculating that they will see updates soon.

    Sure is a different world for Apple when 4-5 months without a product update is a long time. ;)

    HD - I'd agree with you plus you void the warranty doing it yourself.

    RAM - Disagree. Definitely worth the effort to do it yourself. OWC or Crucial for RAM. OWC has RAM rebate for sending in your old RAM. It takes 5 minutes.....

    I was thinking of having to take off the screen and use the anti lint kit, it's a pain, but I just realized I mixed up the RAM its under by the speakers.... totally easy... oops.

    But, $50 too to bad to just have it done.

    Of COURSE Apple was infringing on the patent if you assume it was a valid patent. I'm saying the patent never should have been granted because it's not something you can patent.

    That might be so. But Apple has lots of questionable patents as well. Is the Click-wheel REALLY an innovation worth patenting? "We have a wheel, and we have buttons. Why not conbine them?". IIRC, they are also patenting the Mag-Safe, even though similar systems have been used for long time in pressure-cookers (IIRC).

    And finally, to answer your statement in the first paragraph: This is EXACTLY why the patent system IS messed up.

    Because Apple lost? Yes, patent-system IS messed up. But Apple is taking advatange of it as well. Now that Apple lost, everybody complains, yet no-one complains when Apple files for obvious patents as well.

    It's been law in the whole country here for many years, not a stupid law at all and I've seen it enforced many times. If you're driving that's where 100% of your attention should be, just because you've got away with it before doesn't mean you always will.

    This has nothing to do with GPS or Location Services and turning those off won't change that. It also has nothing to do with tracking your whereabouts.

    The file contains a log of the cell towers you connected to and when. That's it. This is why the dots are in grids that get bigger the as you leave populated areas and routinely include places you haven't been within 30 miles of.

    This information is most likely used for connection quality monitoring and caching for Assisted GPS cold starts. It is also the same information stored by your cell phone provider no matter what phone you use. As such, "Big Brother" already has the ability to access to this information.

    At this point, the only person potentially aided by this discovery is a suspicious spouse.

    I'll post.

    The primary objection of studios to iTS (iTunes Store) is not rental vs. ownership. It is pissing off its physical channel "partners".

    Steve Jobs has a history of pissing off physical channel partners. When the online Apple Store was vastly enlarged and promoted, the value added dealers lost premium CPU and software sales to Apple itself, since they have a price fixing contract. Consumers were no worse off ordering direct with free shipping than going down to a dealer if they did not need advise for the product purchase. In addition many asked questions of local dealers then purchased online thereafter.

    This was further an issue when Apple added their own dealer network (stores) which were to a large degree competing with the long-standing dedicated dealer network as well as the mass merchandising dealers, who have been really hit and miss over the years. That has resulted in low mindshare as compared to Apple and indy dealers who people at least KNOW have the stuff if they are inclined toward those channels.

    Studios rely on physical store dealers for "impulse sales" which has a different character than online. If you are in the online store software or website, it tries to cross-sell you. But retail impulse sales are targeting people who are not shopping for music at all. They just walk by and see it while shopping for something else. The most powerful example of this is Wal-Mart. They sell CD's as a loss leader to generate store traffic of a key range of demographics. So much so, it is Wal-Mart who is pressuring studios to shun iTS, and to a large degree it is actually working.

    Don't rely on encryption to protect you in any way. The police can crack it, as can hackers, and they can simply demand with a court order that you give them the password. Then you're forced to essentially testify against yourself. No, pleading the 5th won't help.

    That's actually not true in any case I have read about. You can't compel encryption passwords.

    Yeah, my sentiments exactly. This seems pretty useless, at least for me. I can't get too excited about it.

    Hard Drives are mechanical, they die. I would personally use this as a backup and to listen when I am at work. I can have access to my entire music library from multiple devices. I have a 16gb iPhone, my entire library will not come close to fitting on that.

    My nano is already on eBay awaiting a nice metal clad 8GB version, I hope they do an andonised black one though to match my other gadgets.

    What I don't get is why can't Apple enable any iOS device (iPod Touch, iPhone, iPad) as an Airplay target device? Obviously iOS supports it as Apple TV can be a target for Airplay from iTunes.

    I personally love how I get the bad rap, when the woman was the one going under the speed limit and attempted to breakcheck me first. She got what was coming to her. Had she just had some common courtesy and moved over, nothing would of happened. Instead she decided that she had to play traffic cop.

    After a short period Bono spoke, saying that everytime he clapped his hands a child in Africa died...

    The real question is why MS is so bothered about Apple using 'App Store'. Historically MS (almost) never used the word App, instead using the word Programs. Surely MS can come up with many alternatives that describe their own store equally well, if not better. Why fight with Apple over this? I can only conclude that it is to spite Apple, or to ride Apple's coat tails yet again.
    Even if MS is right, logically, linguistically, I find their attitude over this rather puerile. PR-wise it says to me "Apple, if we can't imitate you, we'll sue you"
    MS sinks lower in my opinion by the day.

    Regardless of whether or not there are BDXL notebook drives, do you really think Apple's issue with Blu-Ray is the size the discs can hold? :rolleyes:

    I'm not about to sit here and list off reasons why an internal optical drive is useless today. It's pretty clear that if Apple were to keep the optical drive in their machines they would've upgraded to Blu-Ray a long time ago but they haven't so it's quite clear that they have the intentions of removing it in all of their notebooks in the not so distant future.

    If it were OK to remove the optical drives they would have already done so.

    They are fighting against Blu-Ray. But that's where the notebook market has already moved into.

    There is no way apple with go with Merom for the imac. One huge factor you are all ignoring, is price. Merom cost alot more than conroe for the same speed. Apple will try to lower cost, and that means going with Conroe.

    It's a matter of heat. We can't be sure that they'll go Conroe if the actual heat put off by the chip (ignoring TDP quotes on either side) is much more than a G5.

    I hope they use Conroe though- that would be fantastic.

    But I honestly can't say that I think it will go conroe YET. It would be more likely when they have to redesign the Logic Board next year because Merom's 800MT/S FSB version will have a new socket and need the new Santa Rosa chipset. They'll be just as well off if they do a new LB at that point for Conroe.

    So, in summary...

    Apple pays Creative a one time fee of $100M to licence their patents.

    Creative joins the 'Made for iPod' program making accessories for their competitor, Apple, who gets money for 'Made for iPod'.

    Creative still HAS to defend it's patent against other competitors - that's the nature of patents - or licence it to them. If they do, Apple takes some of that money too. In a round-a-bout way, Apple is getting money back from it's competitors. Nice.

    Creative have a much better case because Apple settled.

    Creative still owns a valid patent. If Apple had won, there would be no patent so anyone could copy the Creative/Apple style interface.

    Apple continues on as if nothing has happened. No long court case delaying sales. No injunctions to halt imports.

    Explain to me why people think Apple lost here?

    Creative knew it was about to get reamed by Microsoft's Zune which it's players aren't compatible with. They knew to get out of the market. Instead of legitimising Microsoft's offering, they've tied up with Apple. It might bug us that Apple have legitimised a bogus patent but it's otherwise very, very smart.

    Interesting, I did not know so many apple fans were lawyers and patent experts. Some call the patent bogus, some claim apple really didn't infringe but felt like being santa claus to creative and some even claim that the lawsuit would have cost apple 100 million (like it would have cost creative 0. Why not slug it out and see how much creative have in the coffers to pay their lawyers?). You guys would all make excellent attorneys!!!.

    I'll summarize.

    1. Apple infringed on the patent
    2. Apple paid license for use of the patent
    3. Go watch TV.. show over folks.

    Apple could blow a hundred million in legal expenses. It's less of an instance of throwing in the towel, and more of an instance of, "You know, the way idiot judges/juries hand out settlements these days, let's just give them a paltry sum, let them think they've won, and still destroy them in the MP3 market."

    Actually, creative won, regardless of whether apple destroys them in the market or not. Man, even Steven (jobs) is not as pissed as you all are. I think he's lying comfortable in his bed right now, probably watching the news. Chill out. Companies infringe on other companies patents all the time. Companies settle all the time. This is not an abnormal event.

    They'll change the key and force a firmware update on any airport express user who wants to update itunes.

    Probably workin' 24/7 on it as we speak... I hope Apple finally stops being Sue Zombie, and realizes the advantages to the consumer for this.

    Apple, go back to the logic that made you what you are - make products for the consumer's hearts & thoughts!
