    if i use EAD for a part time job, does the H1B visa status become invalid?

    yes. look up the archives, this has come up quite a few times. Some people say going from EAD to H1 is a one-way street and coming back requires new H1 subject to cap. Many others (including my attorney) say that you can come back on new H1 (or even existing H1 petition if its not expired) without being subject to quota/cap. Reactivating the H1 does require a trip out and back into the US.

    I have 140 approval notice in mail like 1.5yrs back...just today i put the reciept number on USCIS website and it says still pending..i called USCIS and they say they wont be able to discuss my case since 140 is employer specific only....my employer is sayin dont worry and dont bother about online status...i just want to make sure my 140 is really approved and USCIS has the correct update while lookin at my 485 file...i dont want them to put my 485 in hold just because of they thinkin 140 is not approved...

    I'm not a Guru in Immigration Matters...still from my experience USCIS is pretty random in some cases with online statuses.
    I think I just told you what you know already, but reminding you that you are not alone.
    Any updates gurus?

    How do I get a black border around a box I make using the rectangle tool in Photoshop 6.0? I know there is an easy way to do so, since I see it so often. Did I accidently turn that off, as in, it originally is there, or do I have to toggle something? :q:

    Most states would have domicile requirements that require you to have resided in the state for x number of months/years.

    It could be as little as 1 year.

    In VA its 1 year.

    COBRA is a good option but I know its crazy expensive. They also have a high deductible plan. If your friend does not have kids (or even if he does) you could opt for HD plan - their premiums are much lower (< $500 for family). eg. for a doctors visit, under normal plan he would be paying 40$ copay and insurance would pay in-network negotiated rate of say $120. With HD plan he would need to pay $120 for doctors visit until he reaches deductible of $6k for the year. Not a bad option if you are healthy individual - covers you well in worst case scenario... Ask your family doctor in india to send you imp drugs, antibiotics etc etc. Within 100$ you can cover all medicine expenses...

    Rep. Steve King (R-Iowa) isn�t wasting any time with his immigration agenda, dropping a bill on the first day of Congress that goes after birthright citizenship.

    King�s measure would amend the Immigration and Nationality Act, ending automatic citizenship for anyone born in the country. Instead, the measure requires that only the children of citizens, legal immigrants permanently living in the country or immigrants in the military, be granted citizenship.

    Republicans grabbed headlines last summer after Sen. Lindsey Graham (R-S.C.) criticized the longstanding law, saying it encourages pregnant women to come to the country to have children so they can eventually become citizens themselves.

    Though others have called for changing the 14th Amendment, King said that ending birthright citizenship through statute makes sense because it�s easier to do.

    �We need to address anchor babies,� he told POLITICO Wednesday. �This isn�t what our founding fathers intended.�

    Immigration legislation isn�t high on the list of priorities for House GOP leaders.

    At least five other members � Reps. Phil Gingrey (R-Ga.), Gary Miller (R-Calif.), Rob Woodall (R-Ga.), Brian Bilbray (R-Calif.) and Dana Rohrabacher (R-Calif.) � are co-sponsoring King�s measure.

    Also, you can see, EB1+Eb2ROW has s always been in the 50-70K range every year

    EB1 I/C each is increasing from 3K to 6K, EB2 ROW is increasing from 10K to about 30K

    YOu might have already tried this - pls try emailing any school association there (Indian Students Association) - that might turn up good contacts. They are a couple of good universities out there like Chapel Hill...

The Department of State reported in the September 2010 visa bulletin (http://www.travel.state.gov/visa/bulletin/bulletin_5113.html) that applicants who are spouses or children of greencard holders (filed as late as January 1, 2010) can now be processed for greencards. This is true for applicants from all countries except Mexico and the Dominican Republic, whose priority dates aren't far behind either: January 1, 2009.

    What is a a "priority date," you ask? A "priority date" is a legal term of art that can be exceedingly hard to explain (especially in a blog), but I'll try. Let's start with basics. There is a quota on how many immigrants can come legally to the country per year. Imagine the quota like it is a long line of people lining up for a greencard. The people at the front of the line are those whose relative petitions were filed earliest, ie those with the earliest "priority date." A priority date is established on the date that your petition is received by the USCIS. Of course, the earlier your priority date, the sooner you can later ask for greencard status. Generally, priority dates always move forward, but these dates can also go backwards, and if applications aren't received by USCIS before this "retrogression" happens, applicants are back to the waiting game.

    In the past month, the (F2A) priority date in the the family-based second preference category (ie for spouses and children of greencard holders) advanced from March 2009 to January 2010! This has made an incredible difference to those who have been waiting to be reunited with their spouses and children, rather than expecting a year or more of wait, this category of new immigrants can now start processing their greencard applications.
